Global Terms and Conditions
Governs use of the Dear Future service and every Order placed through it.
1. About Dear Future
These Global Terms and Conditions govern the purchase and use of products and services
offered under the name Dear Future.
The intended operator is:
Dear Future BV/SRL, a Belgian private limited company
Country of establishment: Belgium
Email: info@dearfuture.ink
In these Terms, “Dear Future”, “we”, “us” and “our” refer to the legal entity operating the Dear
Future services.
2. Acceptance of these Terms
By placing an order, the Customer agrees to:
- These Global Terms and Conditions.
- The Privacy Policy.
- Any product-specific terms applying to the selected service.
- Any regional supplement that applies to the Customer or Recipient.
- The information and choices shown during the ordering process.
The Customer must actively accept the applicable Terms before completing payment.
The Privacy Policy explains how personal information is processed. Acknowledging the
Privacy Policy does not replace any separate consent or declaration required during the
ordering process.
Nothing in these Terms excludes, restricts or replaces rights that cannot lawfully be excluded
under applicable consumer, privacy, telecommunications or other mandatory law.
3. Definitions
For these Terms:
Call means a service through which a prerecorded personal audio message is delivered
through an automated telephone call or, where offered, a secure online listening page.
Content means any written text, letter, PDF, audio recording, image, attachment, metadata
or other material provided to or created through Dear Future.
Customer means the individual or organisation that creates, purchases, stores or manages
Content through Dear Future.
Delivery Date means the requested date or delivery period selected by the Customer. It is a
target date and is subject to the delivery windows and limitations described in these Terms
and the applicable product terms.
Delivery Details means the Recipient’s name, address, telephone number, email address,
country, time zone and other information necessary to attempt delivery.
Letter means a service through which Content is printed and dispatched as physical mail.
Message means the Content that the Customer asks Dear Future to store and deliver.
Order means the Customer’s purchase of a Dear Future service.
Product Terms means the additional terms applying to a specific product, including the
Letter Service Terms and Call Service Terms.
Recipient means the person for whom the Message is intended. The Customer and
Recipient may be the same person.
Service Availability Page means the current information published by Dear Future
concerning supported destinations and delivery methods.
Service Provider means a third party used for hosting, storage, payments, printing, postal
delivery, telecommunications, email, analytics, security or another operational purpose.
4. Order of precedence
The agreement may consist of:
- A specific written agreement signed by Dear Future and the Customer.
- A mandatory regional supplement.
- The Product Terms for the selected service.
- These Global Terms and Conditions.
- Information shown during checkout.
- The Privacy Policy and other notices.
If two provisions conflict, the more specific provision will normally prevail over the more
general provision.
Mandatory law always prevails where it cannot lawfully be varied by contract.
5. Eligibility
A Customer must:
- Be at least eighteen years old.
- Have legal capacity to enter into a binding agreement.
- Provide accurate and complete information.
- Be authorised to use the selected payment method.
- Have the rights and permissions required for the Content and Delivery Details.
- Comply with these Terms and applicable law.
Where the age of legal majority is higher than eighteen in the Customer’s jurisdiction, the
Customer must have reached that higher age.
A person acting for an organisation represents that they are authorised to bind that
organisation.
6. Messages intended for minors
An adult may create a Message intended for a person under eighteen where the adult:
- Is the child’s parent or legal guardian; or
- Is otherwise legally authorised to provide the relevant information;
- Acts lawfully and in the child’s interests;
- Does not include unnecessary sensitive information;
- Complies with applicable consent and privacy requirements.
A minor may not independently purchase or manage a paid Dear Future service.
Dear Future may refuse, suspend or remove a Message concerning a minor where there is a
reasonable concern about authority, safety, legality or the child’s interests.
7. Consumer and business Customers
These Terms apply to both individual consumers and organisations unless separate written
terms apply.
For larger business, educational, event or institutional arrangements, Dear Future may
require:
- A separate commercial agreement.
- A data processing agreement.
- Additional security terms.
- Minimum-order commitments.
- Separate pricing.
- Additional recipient-consent procedures.
A business Customer is responsible for ensuring that its employees, representatives and
authorised users comply with these Terms.
8. Description of the services
Dear Future enables Customers to:
- Create or provide written or recorded Content.
- Store that Content for a selected period.
- Arrange future physical or telephone delivery.
- Manage certain Delivery Details.
- Cancel future delivery.
- Request deletion, subject to legal retention requirements.
Services may include:
- Physical Letters.
- Prerecorded Calls.
- Secure online listening following an unsuccessful Call.
- Future physical or digital message-storage products.
- Related support and delivery-management services.
The features, price, supported destinations, technical limitations and delivery method for
each service are shown before purchase or in the relevant Product Terms.
9. Nature and limitations of the services
Dear Future is a personal message-storage and future-delivery service.
It is not:
- An emergency communications service.
- A medical or mental-health service.
- A legal-notice or proof-of-service provider.
- A registered-mail guarantee unless explicitly stated.
- A notary.
- A testamentary or estate-planning service.
- A fiduciary, trustee, executor or guardian.
- A regulated long-term archival institution.
- A financial institution.
- A guaranteed identity-verification service.
- A guaranteed method for communicating urgent or legally significant information.
Customers must not use Dear Future where a delay, failed delivery or disclosure to the
wrong person could reasonably cause death, personal injury, serious financial harm or loss
of legal rights.
Messages containing urgent instructions should also be communicated through an
appropriate immediate channel.
10. Service availability
Dear Future offers services internationally, but not every product or delivery method is
available in every country.
Availability depends on matters including:
- Pingen’s printing and postal coverage.
- Bird’s telecommunications coverage.
- Local carrier availability.
- Address and number formats.
- Sanctions and trade restrictions.
- Postal suspensions.
- Local telecommunications rules.
- Recipient-consent requirements.
- Technical compatibility.
- Dear Future’s own legal approval of the destination.
A destination is available only where:
- The relevant Service Provider technically supports it.
- Dear Future has approved it for the selected service.
- It is shown as available during checkout.
The current availability may be shown during ordering and on the Service Availability Page.
Technical support by Pingen or Bird does not by itself mean that Dear Future offers the
service in that country.
11. Changes in country availability
Country availability may change after an Order due to:
- Armed conflict.
- Sanctions.
- Government restrictions.
- Postal suspension.
- Telecommunications restrictions.
- Carrier changes.
- Regulatory developments.
- Safety concerns.
- Events outside Dear Future’s reasonable control.
Where a destination becomes unavailable before delivery, Dear Future may offer:
-
A different delivery date.
-
An alternative delivery method.
-
Delivery to another supported destination.
-
Secure export of the Content.
-
Earlier delivery.
-
Cancellation and an appropriate refund.
-
Another reasonable solution.
The Customer may be required to provide updated Delivery Details.
12. Formation of the contract
An Order is submitted when the Customer:
- Completes the required information.
- Accepts the applicable legal documents.
- Makes the required declarations.
- Confirms the selected product.
- Submits payment.
A binding contract is formed when:
- Payment is successfully authorised; and
- Dear Future sends an Order acceptance or confirmation.
An automated technical acknowledgement does not constitute acceptance where it
expressly states that the Order remains subject to review.
Dear Future may refuse or cancel an Order before acceptance where:
- Payment fails.
- Information is incomplete or inaccurate.
- Fraud or unauthorised use is suspected.
- The Content or intended delivery may be unlawful.
- Required declarations have not been made.
- The destination is unsupported.
- The selected Delivery Date is unavailable.
- The Order presents a security, safety or regulatory risk.
- A Service Provider cannot support the Order.
Where Dear Future refuses an Order after receiving payment, it will normally refund the
payment unless the amount must lawfully be retained because of fraud, chargeback abuse
or another valid reason.
13. Minimum and maximum Delivery Dates
The earliest selectable Delivery Date is normally at least one calendar month after Order
acceptance.
This minimum period allows time for:
- The fourteen-day cancellation period.
- Delivery-detail verification.
- Processing.
- Security checks.
- Production planning.
- Compliance review where necessary.
The maximum period between Order acceptance and the original Delivery Date is ten years.
Dear Future may offer shorter maximum periods for particular products, countries or delivery
methods.
Dear Future does not accept Orders with a Delivery Date more than ten years after Order
acceptance unless expressly agreed under a separate product or contract.
14. Customer information
The Customer must provide accurate and current information, including:
- Full name.
- Valid email address.
- Country of residence.
- Billing information.
- Recipient information.
- Delivery Date.
- Other information reasonably required for the selected service.
The Customer must maintain access to the email address associated with the Order.
Where the Customer’s own contact information changes, the Customer must update Dear
Future as soon as reasonably possible.
Dear Future is not responsible for a failure to reach the Customer caused by outdated or
inaccessible Customer contact information, except to the extent caused by Dear Future’s
own breach.
15. Choosing “for myself” or “for someone else”
The Customer must indicate whether the Message is intended:
- For the Customer; or
- For another person.
Where the Customer selects “for someone else”, additional declarations concerning the
Recipient and the Content apply.
The Customer must not select “for myself” to avoid recipient-consent, privacy or no-contact
requirements when the Message is actually intended for someone else.
16. Recipient declarations
Where the Message is intended for another person, the Customer must actively confirm that
the Recipient has been informed and has agreed to the intended use of their contact details.
By making this confirmation, the Customer represents and warrants that:
- The Recipient knows that their contact information is being provided to Dear Future.
- The Recipient knows that Dear Future will store and use those details for future
delivery of a personal Message. - The Recipient was given access to the Dear Future Recipient Privacy Notice.
- The Customer is legally permitted to provide the Recipient’s information.
- The Recipient has agreed to the intended use of their information.
- The Recipient has not objected or withdrawn their agreement.
- The Recipient has not asked the Customer to stop the relevant contact.
- No block, no-contact request, restraining order, protective order, contact prohibition
or similar restriction applies. - The information is accurate to the best of the Customer’s knowledge.
- The intended delivery is not harassment, stalking, intimidation or an attempt to
circumvent the Recipient’s wishes. - The Customer will promptly inform Dear Future if the circumstances change before
delivery.
For a Call, the confirmation also means that the Recipient specifically agreed to receive an
automated or prerecorded personal Call from Dear Future at the number provided.
The Terms do not create permission on behalf of the Recipient. The Customer confirms that
the required permission already exists.
17. Evidence concerning the Recipient
Dear Future may request reasonable evidence that:
- The Recipient was informed.
- The Recipient received or could access the Recipient Privacy Notice.
- The Recipient agreed to the relevant use of their contact information.
- A Call was specifically authorised.
- No legal or personal contact restriction applies.
Dear Future does not routinely require evidence during every Order.
Evidence may be requested where:
-
A Recipient makes a complaint.
-
The Recipient denies providing permission.
-
Harassment or misuse is suspected.
-
A legal restriction may apply.
-
A regulator or court requests information.
-
The destination has heightened consent requirements.
-
The Order presents an unusual safety risk.
Dear Future may pause or cancel delivery if the Customer does not provide reasonable
evidence when requested.
After the fourteen-day cancellation period, cancellation arising from a Recipient objection or
failure to demonstrate permission does not normally create a right to a refund.
Mandatory local rights remain unaffected.
18. Calls to another person
For a Call intended for another person, the Customer must confirm that the Recipient
specifically agreed to:
- Receive an automated or prerecorded Call from Dear Future.
- Receive the Call at the telephone number provided.
- Receive the personal audio Message.
- Receive the maximum number of delivery attempts stated during ordering.
- Receive an email following an unsuccessful attempt.
- Use an online rescheduling or listening option where offered.
- The identity-confirmation step used before playback.
General permission to contact the Recipient is not necessarily sufficient.
The Customer must immediately notify Dear Future if the Recipient withdraws permission.
Dear Future may request proof or cancel the Call if the required permission cannot
reasonably be established.
19. Content declaration
Before completing the Order, the Customer must confirm that they are legally permitted to
include the personal information contained in the Message.
Where the Content includes sensitive personal information about the Customer, the
Customer expressly consents, where required, to Dear Future processing that information
solely to:
- Store the Message.
- Protect the Message.
- Perform necessary technical processing.
- Produce the delivery.
- Deliver the Message.
The Customer must not include sensitive personal information about another person unless
the Customer is legally permitted to do so.
The Customer must not assume that their acceptance of these Terms creates consent on
behalf of another person.
20. Customer responsibility for Content
The Customer is responsible for:
- The Content they provide.
- The accuracy of the Content.
- The lawfulness of the Content.
- Obtaining necessary rights and permissions.
- Verifying that files are complete and usable.
- Ensuring that the intended delivery is appropriate.
- Keeping an independent copy where desired.
- Complying with the Acceptable Use Policy.
- Avoiding unnecessary personal information about third parties.
Dear Future does not provide legal advice about whether particular Content may lawfully be
included or delivered.
21. Content cannot be changed after payment
Once the Order has been accepted and payment has been completed, the Message Content
is treated as final.
The Customer may not normally:
- Rewrite the Message.
- Replace the Letter.
- Replace the audio recording.
- Add or remove pages.
- Change the substantive Content.
- Change the identity of the Sender.
The Customer may cancel and delete the Order in accordance with these Terms, but
cancellation does not create a right to submit replacement Content under the same Order.
Dear Future may correct a purely technical problem where:
- The Content is unreadable.
- A file is corrupt.
- Technical conversion failed.
- Dear Future caused the defect.
A correction under this section does not permit a substantive rewrite.
22. Updating Delivery Details
The Customer may update Delivery Details until the applicable product cut-off.
Permitted updates may include:
- Recipient postal address.
- Recipient telephone number.
- Recipient email address.
- Destination country, where supported.
- Time zone.
- Limited delivery instructions.
Dear Future may require verification before accepting a change.
Dear Future may reject an update where:
- It appears fraudulent.
- It redirects delivery to an unauthorised person.
- The new country is unsupported.
- Required Recipient permission has not been confirmed.
- Production or delivery has already started.
- The change creates a legal or safety risk.
Address changes are normally free before the Letter production cut-off.
Changes after a cut-off are not guaranteed.
23. Ownership of Customer Content
The Customer retains any intellectual-property rights they hold in their Content.
The Customer grants Dear Future and its Service Providers a limited, non-exclusive,
worldwide licence to:
- Receive the Content.
- Store it.
- Encrypt it.
- Make security and backup copies.
- Validate the file.
- Convert it into a supported technical format.
- Generate necessary production files.
- Print it.
- Transmit it to delivery providers.
- Play it during a Call.
- Provide secure online access.
- Perform the contracted service.
- Investigate a technical, security or legal issue.
The licence is limited to operating, securing and completing the service.
It ends when the Content is deleted, except for:
- Copies temporarily remaining in backups.
- Information required for legal claims.
- Information required by law.
- Technical records that do not contain the substantive Content.
Dear Future does not acquire ownership of the Customer’s Message.
24. No secondary commercial use of private Content
Dear Future will not use private Message Content for:
- Advertising.
- Targeted marketing.
- Marketing profiles.
- Behavioural profiling.
- Assessing the Customer or Recipient.
- Credit, employment, insurance or eligibility decisions.
- Sale to data brokers.
- Rental to advertisers.
- Training general-purpose artificial-intelligence models.
- Unrelated direct marketing to the Recipient.
Dear Future may use limited Content where reasonably necessary for:
- Malware detection.
- Technical validation.
- Technical conversion.
- Printing.
- Call delivery.
- Customer support.
- Fraud investigation.
- Investigation of a specific complaint.
- Prevention of serious misuse.
- Compliance with law.
- Protection from a credible threat of serious harm.
25. Prohibited use
The Customer must not use Dear Future for:
-
Harassment.
-
Stalking.
-
Threats.
-
Intimidation.
-
Blackmail.
-
Extortion.
-
Hate or unlawful discrimination.
-
Incitement to violence.
-
Sexual exploitation.
-
Sexual material involving minors.
-
Fraud or phishing.
-
Identity theft.
-
Impersonation.
-
Malware or technical attacks.
-
Unlawful disclosure of confidential information.
-
Unlawful publication of personal information.
-
Copyright or intellectual-property infringement.
-
Unwanted commercial communications.
-
Circumvention of a block or no-contact request.
-
Circumvention of a restraining or protective order.
-
Emergency or time-critical instructions.
-
Instructions primarily intended to facilitate serious criminal conduct.
-
Any purpose prohibited by applicable law.
The service must not be used to cause the Recipient distress merely because delivery is
delayed into the future.
The full rules may also be set out in the Acceptable Use Policy.
26. Moderation and limited review
Dear Future does not routinely read or listen to private Content.
Dear Future may perform automated or human review where reasonably necessary to:
- Detect malware.
- Check technical compatibility.
- Investigate a complaint.
- Investigate suspected prohibited use.
- Respond to a security incident.
- Provide support.
- Protect a person against a credible serious threat.
- Comply with a legally valid request.
- Prepare or complete delivery.
Review will be limited to what is reasonably necessary.
Dear Future may pause, block, remove or decline to deliver Content where there is a
reasonable belief that:
-
These Terms were violated.
-
The Content is unlawful.
-
The delivery would be unsafe.
-
The Recipient’s rights would be violated.
-
Required permission is absent.
-
A legal restriction applies.
Dear Future is not required to provide advance notice where doing so would increase a
safety risk, interfere with an investigation or violate the law.
27. Storage period
A paid Message may be stored until:
- The Delivery Date.
- Completion of the agreed delivery attempts.
- Expiry of the applicable post-delivery or failed-delivery period.
The original Delivery Date may be no more than ten years after Order acceptance.
The Privacy Policy contains the detailed retention schedule.
Storage may end earlier where:
- The Customer cancels.
- A valid deletion request is received.
- The Recipient objects.
- Permission is withdrawn.
- The Message violates these Terms.
- Dear Future is legally required to delete it.
- Continuing storage presents a safety or security risk.
- The service is discontinued in accordance with these Terms.
28. Technical migration and format conversion
The Customer authorises Dear Future to make reasonable technical changes necessary to
preserve and deliver the Message.
This may include:
- Copying encrypted Content to replacement infrastructure.
- Migrating between storage providers.
- Converting audio or document formats.
- Replacing obsolete file formats.
- Changing encryption methods.
- Creating temporary production copies.
- Updating APIs or delivery integrations.
- Replacing Pingen, Bird or another Service Provider.
Dear Future will not intentionally change the substantive meaning of the Message.
Minor differences in:
- Audio encoding.
- Volume.
- Pagination.
- Scaling.
- Colour reproduction.
- Print alignment.
- File metadata.
may result from technical conversion or production.
29. Delivery Dates are targets
The Delivery Date is the requested or targeted date for delivery.
Dear Future does not guarantee:
- Delivery at an exact time.
- Postal arrival on an exact calendar day.
- That the Recipient will personally receive the Letter.
- That the Recipient will answer the Call.
- That the Recipient will open, read, hear or understand the Message.
- That an address or telephone number will still belong to the same person.
- That postal or telecommunications networks will operate without interruption.
Product-specific delivery windows and attempts are described in the Product Terms.
The Customer must not rely on Dear Future for a purpose where exact delivery is essential.
30. Preparation before the Delivery Date
Dear Future may begin technical or operational preparation before the Delivery Date.
This may include:
- Validating an address.
- Converting the file.
- Preparing a Letter for production.
- Transferring information to a Service Provider.
- Scheduling a Call.
- Creating a temporary playback copy.
- Sending a service email.
A production cut-off may apply.
For Letters, the intended production cut-off is normally fourteen days before the Delivery
Date.
After the cut-off, changes or cancellation may not stop production or dispatch.
31. Letter services
Letter services are subject to the Letter Service Terms.
The Customer acknowledges that physical delivery depends on:
- File compatibility.
- Address accuracy.
- Pingen.
- Printing partners.
- International and local postal operators.
- Customs and border controls.
- Local delivery conditions.
Unless otherwise stated:
- The Letter must be supplied or generated as a PDF.
- The maximum length is seven pages.
- A4 is the supported page format.
- Colour and black-and-white printing may be offered.
- A preview is not guaranteed.
- The Customer must confirm the relevant information before purchase.
- Tracking is not included.
- Dear Future may make one replacement shipment where the conditions in the Letter
Service Terms are met. - There is no third shipment under the same Order.
The separate Letter Service Terms govern print tolerances, postal delays, returned post,
replacement shipments and provider limitations.
32. Call services
Call services are subject to the Call Service Terms.
Unless otherwise stated:
-
The maximum personal audio duration is ten minutes.
-
A telephone number and email address are required for the Recipient.
-
Dear Future may make up to three Call attempts.
-
Attempts may occur on three different days.
-
Calls may be placed between 08:00 and 21:00 in the Recipient’s local time.
-
Weekend attempts may occur where legally permitted.
-
The personal Message is not intentionally left on voicemail.
-
The Recipient must complete an identity-confirmation step before playback.
-
Dear Future does not intentionally record the Recipient.
-
A failed attempt may be followed by an email permitting rescheduling or secure
online listening. -
The displayed caller ID may change.
-
The Recipient cannot rely on being able to call the number back.
The Call Service Terms contain the complete rules concerning permission, attempts, time
zones, voicemail, carrier blocking and secure listening.
33. Identity confirmation during a Call
Before playing the personal recording, Dear Future may play an introduction such as:
“This is Dear Future with a personal message intended for [first name]. If you
are the intended recipient, press 1 to continue. Otherwise, please hang up.”
The personal Message will not be played unless the required confirmation is received.
This measure reduces, but cannot completely eliminate, the risk that:
- Another person answers the telephone.
- Someone falsely confirms being the Recipient.
- The telephone is shared.
- Another person has access to the Recipient’s device.
The Customer accepts that telephone delivery cannot provide an absolute identity
guarantee.
34. Third-party Service Providers
Dear Future relies on Service Providers including:
- Vercel for infrastructure and storage.
- Stripe for payments.
- Resend for transactional email.
- Pingen for printing and postal delivery.
- Bird for telephone delivery.
- Google for analytics and address-related services.
- Postal and telecommunications operators.
Dear Future remains responsible for its own contractual obligations to the extent required by
applicable law.
Dear Future does not control every aspect of:
-
Postal networks.
-
Telecommunications networks.
-
Local carriers.
-
Customs.
-
Provider outages.
-
Spam or call-blocking systems.
-
Recipient devices.
-
Email filtering.
Dear Future will select and manage providers with reasonable care and will seek appropriate
contractual protections.
Product availability, delivery windows and provider capabilities may change.
35. Prices
The price shown before the Order is submitted is the price payable, subject to correction of
an obvious error.
The price may include components relating to:
- Storage.
- Technical processing.
- Production.
- Printing.
- Postal delivery.
- Telephone delivery.
- Service administration.
- Taxes.
The checkout will state whether taxes are included.
The Customer is responsible for:
- Applicable taxes shown at checkout.
- Bank fees.
- Currency-conversion fees.
- Charges imposed by the Customer’s payment provider.
- Any duty expressly stated as the Customer’s responsibility.
The Recipient may incur ordinary telephone, roaming, internet or email-access charges
imposed by their own provider. Dear Future does not receive those charges.
36. Payment
Payment is processed through Stripe or another disclosed payment provider.
The Customer authorises:
- The initial charge.
- Any taxes disclosed at checkout.
- Any separately approved replacement or additional service charge.
Dear Future does not ordinarily receive complete payment-card information.
An Order may be suspended or cancelled where:
- Payment is refused.
- Payment is reversed.
- A chargeback is opened.
- Fraud is suspected.
- The payment method was used without authority.
A chargeback does not automatically cancel the future-delivery obligation. The Customer
should first contact Dear Future so that the Order can be reviewed.
37. Fourteen-day cancellation period
Dear Future offers the Customer a fourteen-day cancellation period beginning on the date
the Order is accepted.
During this period, the Customer may:
- Cancel without giving a reason.
- Receive a full refund.
- Request deletion of the Message and Delivery Details.
- Update permitted Delivery Details.
No cancellation fee is charged.
The Customer may not replace or rewrite the Message Content after payment.
Dear Future will not intentionally submit the Letter to Pingen for production or begin
Call-delivery attempts through Bird during the fourteen-day period.
Mandatory statutory rights may provide additional or different protection.
38. How to cancel within fourteen days
The Customer may cancel by sending a clear request to:
info@dearfuture.ink
The request should include enough information to identify the Order, such as:
- Order number.
- Customer email address.
- Customer name.
A cancellation sent before the deadline is timely where the Customer can reasonably
demonstrate when it was sent.
Dear Future will send an electronic acknowledgement after receiving the cancellation
request.
Where applicable law requires an additional online withdrawal or cancellation function, Dear
Future will provide or honour that function.
The Customer may also use any other legally valid method required by mandatory law.
39. Refund within fourteen days
Following a valid cancellation within fourteen days, Dear Future will refund the payment
using the original payment method unless:
- The Customer agrees to another method.
- The original method cannot reasonably receive the refund.
- Applicable law permits another method.
The refund will be issued without undue delay and within the legally required period.
Dear Future will not charge a refund-processing fee.
Bank or currency-conversion differences outside Dear Future’s control may not be
recoverable.
40. Cancellation after fourteen days
After the fourteen-day period, the Customer may still ask Dear Future to:
- Cancel future delivery.
- Stop remaining delivery attempts.
- Delete the Message.
- Delete Delivery Details, subject to legal retention.
- Close the Order.
Dear Future does not charge a separate cancellation fee.
Unless required by applicable law or caused by Dear Future’s failure, amounts already paid
are not refundable after the fourteen-day period.
This reflects the reserved long-term storage, administration, technical infrastructure and
future-delivery capacity associated with the Order.
41. Situations in which a later refund may still apply
A refund, credit, replacement or other remedy may still be required or offered after fourteen
days where:
-
Dear Future cannot provide the purchased service.
-
Dear Future cancels the Order for reasons not caused by the Customer.
-
Dear Future materially breaches the agreement.
-
The service is legally defective or non-conforming.
-
A supported destination becomes unavailable and no reasonable alternative is
accepted. -
Dear Future made a material error.
-
Mandatory consumer law requires a remedy.
-
Another remedy is agreed in writing.
Any contractual limitation is subject to mandatory local rights.
42. Cancellation, withdrawal and deletion are different
A contractual cancellation stops the future service.
A statutory withdrawal is a legal right available in certain jurisdictions and circumstances.
A privacy deletion request asks Dear Future to delete personal information.
A Recipient objection asks Dear Future to stop using the Recipient’s information or stop
delivery.
These requests may have different legal and financial consequences.
Deletion or objection does not automatically create a right to a refund.
A refund does not require Dear Future to delete financial, fraud, legal or compliance records
that must lawfully be retained.
43. Failed delivery
Delivery may fail because:
- The postal address is incorrect or outdated.
- The telephone number is incorrect, inactive or reassigned.
- The Recipient moved.
- The Recipient cannot be reached.
- The Recipient refuses delivery.
- A carrier blocks the Call.
- A Call is labelled as spam.
- Email is rejected or filtered.
- The Recipient does not complete identity confirmation.
- The Customer failed to update information.
- A postal or telecommunications provider fails.
- A legal restriction prevents delivery.
A failed delivery does not automatically mean that Dear Future breached the agreement.
The applicable Product Terms determine:
- The number of attempts.
- Whether a replacement is available.
- Who bears replacement costs.
- When the service is considered completed.
- How long the Message remains available after failure.
44. Replacement Letter shipment
Dear Future may provide one replacement Letter shipment, resulting in a maximum of two
shipments under the original Order.
The replacement may be provided without additional charge where:
- The original Delivery Details were accurate and timely updated.
- The failure was not caused by the Customer or Recipient.
- A replacement remains reasonably possible.
- The Customer responds within the applicable period.
Dear Future may charge the Customer for the replacement where:
- The Customer provided an incorrect or outdated address.
- The Customer failed to update the address before the cut-off.
- The Customer requests a different destination.
- Additional production or postage costs arise because of the Customer’s instructions.
The detailed conditions will appear in the Letter Service Terms.
45. Call attempts
Dear Future may make up to three Call attempts under one Call Order.
The service may be treated as performed where:
- Dear Future made the promised attempts in accordance with the Call Service Terms;
and - The attempts failed because the Recipient did not answer, confirm identity,
reschedule or use the secure listening option.
Dear Future does not guarantee that the Recipient will hear the Message.
Additional attempts beyond the stated maximum require a new agreement or discretionary
approval by Dear Future.
46. Recipient complaints and objections
A Recipient may contact info@dearfuture.ink to:
- Report unwanted contact.
- Deny giving permission.
- Report an incorrect address or telephone number.
- Withdraw Call permission.
- Report harassment.
- Report a no-contact request.
- Report a legal restriction.

the matter.
Dear Future may:
- Request identity verification.
- Ask the Customer for evidence.
- Suspend delivery.
- Cancel delivery.
- Correct or delete Delivery Details.
- Place the contact information on a suppression list.
- Restrict the Customer.
- Delete the Message.
- Investigate limited Content.
- Seek legal advice.
- Contact a competent authority where required.
Where delivery is stopped because of a Recipient objection, missing permission or
Customer breach, no refund is normally due after the fourteen-day cancellation period.
47. Customer cooperation
The Customer must reasonably cooperate with Dear Future regarding:
- Identity verification.
- Payment disputes.
- Recipient complaints.
- Permission evidence.
- Address corrections.
- Security incidents.
- Legal requests.
- Suspected fraud.
- Prohibited Content.
Failure to cooperate may result in suspension or cancellation.
Dear Future will not request more information than reasonably necessary for the issue.
48. Confidentiality
Dear Future treats private Messages as confidential.
Confidentiality is subject to the limited access and disclosures described in:
- These Terms.
- The Privacy Policy.
- The Product Terms.
- Applicable law.
The Customer acknowledges that delivery necessarily requires disclosure to:
- The intended Recipient.
- Relevant printing providers.
- Postal operators.
- Telephone providers.
- Necessary infrastructure providers.
Physical mail, email and telecommunications networks cannot provide absolute
confidentiality.
49. Security
Dear Future will use technical and organisational safeguards appropriate to the nature and
risk of the services.
Safeguards may include:
- Encryption.
- Private file storage.
- Restricted access.
- Multi-factor authentication.
- Separate storage of Content and Delivery Details.
- Access logging.
- Secure backups.
- Automatic deletion.
- Incident-response procedures.
- Supplier controls.
No system is completely secure.
The Customer must protect:
-
Passwords.
-
Email accounts.
-
Devices.
-
Order-management links.
-
Access codes.
-
Secure listening links.
Dear Future is not responsible for access caused by the Customer intentionally sharing
access credentials or failing to take reasonable security precautions, except where
mandatory law provides otherwise.
50. Security incidents
If a security incident materially affects an Order, Dear Future may:
- Suspend access.
- Pause delivery.
- Reset links or credentials.
- Contact the Customer or Recipient.
- Move Content to replacement infrastructure.
- Notify authorities.
- Take other reasonable protective action.
Dear Future will provide legally required notifications.
A temporary protective suspension does not itself create a right to compensation where the
suspension was reasonable and necessary, except where mandatory law provides
otherwise.
51. Service changes
Dear Future may change a service to:
- Improve security.
- Comply with law.
- Replace a Service Provider.
- Maintain technical compatibility.
- Support a new file format.
- Address an unavailable postal or telephone route.
- Improve accessibility.
- Prevent misuse.
For existing paid Orders, Dear Future will not materially reduce the core purchased service
without:
- A valid legal or security reason; or
- Offering a reasonable alternative or remedy.
A change that does not materially disadvantage the Customer may be implemented without
individual consent.
52. Long-term technological change
The Customer acknowledges that a service lasting up to ten years may be affected by
technological change.
Dear Future may need to:
- Replace software.
- Migrate storage.
- Replace encryption.
- Convert files.
- Change hosting regions.
- Replace a telephone or postal provider.
- Update identity-confirmation methods.
- Replace caller IDs.
- Discontinue an obsolete feature.
Dear Future will use reasonable care to preserve the Message and continue the intended
service.
Dear Future does not guarantee preservation in the exact original technical format.
53. Business continuity
Dear Future will maintain commercially reasonable arrangements intended to support
long-term performance.
These may include:
- Secure backups.
- Provider-replacement plans.
- Records of outstanding future deliveries.
- Data-export procedures.
- Recovery procedures.
- Access restrictions.
- Transfer procedures.
- Incident-response arrangements.
These measures reduce risk but do not guarantee that every conceivable event can be
overcome.
54. Sale, restructuring or transfer of Dear Future
Dear Future may transfer its business or service obligations as part of:
-
A sale.
-
Merger.
-
Reorganisation.
-
Financing.
-
Insolvency process.
-
Transfer to a successor.
-
Transfer to an affiliated entity.
Dear Future may transfer existing Orders to a suitable successor where reasonably
necessary to continue the service.
Where possible, Dear Future will require the successor to:
- Honour existing Orders.
- Protect Message confidentiality.
- Maintain appropriate security.
- Use personal information only for lawful continuation.
- Respect objections and no-contact records.
- Follow applicable retention and deletion obligations.
- Avoid using private Content as an unrelated commercial dataset.
The Customer consents to a reasonable transfer that does not materially reduce their rights,
subject to mandatory law.
55. Planned service closure
If Dear Future plans to discontinue a service, it may take one or more of the following steps:
- Continue existing Orders until completion.
- Transfer Orders to a suitable successor.
- Appoint replacement Service Providers.
- Offer earlier delivery.
- Offer secure export.
- Offer an alternative delivery method.
- Offer cancellation.
- Provide an appropriate full or partial refund.
- Delete Content where safe continuation is impossible.
Dear Future will choose the option or combination of options that is reasonably appropriate
in the circumstances.
The Customer may not insist on a particular option where that option is technically, legally or
commercially impossible.
Mandatory consumer rights remain unaffected.
56. Insolvency or circumstances making continuation
impossible
If insolvency or another event makes normal continuation impossible, Dear Future will seek,
to the extent reasonably and legally possible, to:
- Protect outstanding Messages.
- Preserve confidentiality.
- Prevent unauthorised commercial use.
- Enable transfer, delivery, export or deletion.
- Inform Customers.
- Cooperate with an authorised administrator or successor.
Dear Future cannot guarantee continued performance following insolvency, catastrophic
infrastructure loss, legal prohibition or another event beyond its reasonable control.
Nothing in this section excludes liability that cannot lawfully be excluded.
57. Private Content is not a standalone saleable asset
Dear Future will not intentionally sell private Message Content or Recipient contact
information as a standalone:
- Advertising database.
- Marketing list.
- Data-broker product.
- Artificial-intelligence training dataset.
- Public archive.
This does not prevent the controlled transfer of information to a legitimate business
successor where reasonably necessary to continue existing services and subject to
appropriate safeguards.
58. Suspension
Dear Future may temporarily suspend an Order or account where reasonably necessary to:
- Investigate fraud.
- Review a Recipient complaint.
- Verify permission.
- Prevent harassment.
- Protect a person.
- Respond to a security incident.
- Resolve a payment dispute.
- Comply with law.
- Prevent prohibited Content delivery.
- Address a provider failure.
Where appropriate, Dear Future will explain the reason and allow the Customer to respond.
Immediate suspension may occur where there is a serious legal, security or safety risk.
59. Termination by Dear Future
Dear Future may terminate an Order or account where:
- The Customer materially breaches these Terms.
- The Customer knowingly makes a false Recipient declaration.
- The Customer uses the service for harassment or illegal purposes.
- Payment is fraudulent.
- Required permission does not exist.
- A legal restriction prevents performance.
- Continued performance would create a serious safety or security risk.
- The Customer repeatedly abuses support, payment or complaint processes.
- Dear Future is legally required to terminate.
The refund outcome will depend on:
- The reason for termination.
- Work already performed.
- The Customer’s conduct.
- Mandatory law.
No refund is normally due where termination results from deliberate unlawful or prohibited
conduct.
60. Customer termination
The Customer may terminate an Order by cancelling it in accordance with Sections 37 to 42.
Termination stops future performance but does not affect:
- Rights already accrued.
- Payment obligations already incurred.
- Legal retention.
- No-contact records.
- Fraud investigations.
- Legal claims.
- Provisions intended to survive termination.
61. Dear Future intellectual property
Dear Future or its licensors own the rights in:
-
The website.

-
Logos.
-
Designs.
-
Templates.

-
Other materials supplied by Dear Future.
The Customer may not, except where legally permitted:

- Reverse engineer the software.
- Circumvent security.
- Remove proprietary notices.
- Use Dear Future branding without permission.
- Access systems through unauthorised automation.
- Interfere with the website or infrastructure.
- Present themselves as Dear Future.
Ownership of the Customer’s Message remains governed by Section 23.
62. Feedback
The Customer may voluntarily provide ideas, suggestions or feedback.
The Customer grants Dear Future a worldwide, perpetual, non-exclusive, royalty-free right to
use that feedback to improve the services.
This section does not give Dear Future permission to use private Message Content as
feedback unless the Customer separately and clearly provides it for that purpose.
63. Disclaimer of warranties
To the fullest extent permitted by law, Dear Future does not guarantee:
- Exact-time delivery.
- Exact-day postal arrival.

This section does not exclude:
-
Mandatory consumer guarantees.
-
Express contractual commitments.
-

64. Liability that is not excluded
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Depending on applicable law, this may include liability for:
- Fraud.
- Fraudulent misrepresentation.
- Wilful misconduct.
- Gross negligence.
- Death or personal injury caused by negligence.
- Deliberate violation of rights.
- Mandatory consumer remedies.
- Other non-excludable liability.
65. Excluded categories of loss
To the fullest extent permitted by law, Dear Future is not liable for indirect or consequential
losses that were not reasonably foreseeable when the Order was accepted.
This may include:
- Loss of opportunity.
- Loss of anticipated emotional benefit.
- Loss of profit.
- Loss of revenue.
- Loss of business.
- Reputational loss.
- Consequences of relying on a Message for an urgent or legally significant purpose.
This exclusion does not apply where prohibited by mandatory law.
66. Liability cap
Subject to Section 64, Dear Future’s aggregate contractual liability arising from a particular
Order will, to the fullest extent permitted by law, not exceed the greater of:
- The amount paid for the affected Order; or
- EUR 100.
For business Customers, the cap applies to all claims connected with the same event or
series of related events.
For consumers, this cap applies only to the extent permitted by mandatory law and does not
restrict any non-excludable statutory remedy.
67. Circumstances outside Dear Future’s responsibility
Dear Future is not responsible for a loss caused exclusively by:
- Incorrect information supplied by the Customer.
- Failure to update Delivery Details.
- Loss of the Customer’s account or email access.
- Recipient refusal.
- Recipient withdrawal of permission.
- A contact restriction unknown to Dear Future.
- A reassigned telephone number.
- Another person falsely confirming Recipient identity.
- Recipient-device settings.
- Email spam filtering.
- Carrier blocking.
- Customs intervention.
- Postal or telecommunications disruption outside Dear Future’s control.
- Customer breach of these Terms.
This section does not excuse Dear Future’s own negligence, breach or failure to take
reasonable care where liability cannot lawfully be excluded.
68. Customer responsibility for claims
To the extent permitted by law, a Customer is responsible for reasonable losses, liabilities
and costs caused by:
- Unlawful Content supplied by the Customer.
- Deliberately false Recipient declarations.
- Lack of rights in the Content.
- Lack of required permission.
- Harassment or prohibited use.
- Fraud.
- Intentional breach of a no-contact restriction.
- Malware intentionally supplied by the Customer.
- Infringement of another person’s rights.
For consumer Customers, this section applies only to losses reasonably caused by the
Customer’s intentional or negligent conduct and only where enforceable.
For business Customers, Dear Future may require the Customer to defend and indemnify
Dear Future against qualifying third-party claims.
This section does not make the Customer responsible for a loss caused by Dear Future’s
own breach, negligence or unlawful conduct.
69. Force majeure
Dear Future is not responsible for delay or failure caused by an event outside its reasonable
control, including:
- Natural disasters.
- Fire.
- Flood.
- Severe weather.
- War.
- Terrorism.
- Civil unrest.
- Epidemics.
- Government restrictions.
- Sanctions.
- Postal strikes.
- Carrier outages.
- Widespread internet failure.
- Power failure.
- Customs delays.
- Cyberattacks that could not reasonably have been prevented.
- Failure of critical infrastructure despite reasonable safeguards.
Dear Future will take reasonable steps to:
- Reduce the effect.
- Protect stored Content.
- Resume performance.
- Offer a reasonable alternative where possible.
Mandatory cancellation and refund rights remain unaffected.

Customers may contact:
info@dearfuture.ink

- Address or telephone updates.
- Cancellation.
- Security.

Notices may be sent to:
info@dearfuture.ink
A notice concerning:
- Cancellation.
- Privacy.
- Recipient objection.
- Legal restriction.
- Security.
- Formal dispute.
should clearly identify its subject.
Dear Future may later publish separate support, privacy and legal email addresses.
74. Governing law
These Terms are governed by Belgian law.
For consumers, this choice does not deprive the consumer of mandatory protections
provided by the law of the country or region in which the consumer habitually resides.
Where another law must apply under mandatory rules, that law will apply to the required
extent.
75. Courts and jurisdiction
Subject to mandatory consumer jurisdiction rules, disputes will be submitted to the
competent courts of Belgium.
A consumer may retain the right to bring proceedings in the courts of their place of residence
where applicable law permits or requires this.
Nothing in these Terms prevents a person from making a complaint to a competent privacy,
consumer, postal or telecommunications authority.
76. No mandatory arbitration in the Global Terms
These Global Terms do not require consumers to use private arbitration.
Dear Future may later include a voluntary or business-specific dispute-resolution procedure
after separate regional legal review.
No later arbitration provision will override rights that cannot lawfully be waived.
77. Changes to these Terms
Dear Future may update these Terms for future Orders.
The version accepted when an Order was placed will normally continue to govern that Order.
Dear Future may apply a later change to an existing Order where:
- The change is required by law.
- The change is necessary for security.
- The change is necessary to replace a Service Provider.
- The change does not materially disadvantage the Customer.
- The Customer agrees.
- Continued performance would otherwise become impossible.
Where a material change affects an existing Order, Dear Future will provide reasonable
notice where possible.
The version and acceptance time may be recorded for compliance purposes.
78. Assignment by the Customer
The Customer may not transfer an Order or rights under it to another person without Dear
Future’s written agreement.
Dear Future may refuse a transfer where:
- Recipient permission is unclear.
- Identity cannot be verified.
- The transfer creates a privacy or safety risk.
- The new party is in an unsupported country.
- The transfer would alter the intended Recipient or purpose.
This does not prevent a legally authorised representative, executor, administrator or
guardian from acting where applicable law permits it.
79. Assignment by Dear Future
Dear Future may assign or transfer its rights and obligations to:
-
An affiliated entity.
-
A purchaser.
-
A successor.
-
A restructuring entity.
-
An insolvency administrator.
-
Another suitable service operator.
Such a transfer must not unlawfully reduce the Customer’s rights.
Where reasonably possible, the successor will be required to respect:
- Existing Orders.
- Privacy obligations.
- Confidentiality.
- Security.
- Retention.
- Recipient objections.
80. No waiver
If Dear Future does not immediately enforce a provision, that does not mean that the
provision or right has been waived.
A waiver is valid only where clearly communicated by an authorised representative.
81. Severability
If a provision is found invalid or unenforceable:
- The remaining provisions remain effective.
- The provision will be limited or interpreted to the minimum extent necessary where
legally permitted. - A valid provision reflecting the closest lawful commercial purpose may replace it.
82. Entire agreement
These Terms, together with:
- The Product Terms.
- The Privacy Policy.
- Applicable regional supplements.
- The accepted Order details.
- Any separate written agreement.
form the agreement concerning the selected service.
Statements outside these documents do not create a binding commitment unless made or
confirmed by an authorised representative of Dear Future.
83. No third-party contractual rights
Unless expressly stated or required by law, a person who is not a party to the agreement
does not receive contractual enforcement rights under these Terms.
This does not limit:
- A Recipient’s privacy rights.
- A Recipient’s right to object.
- A person’s rights under mandatory law.
- Rights granted to an authorised representative.
84. Interpretation
Section headings are for convenience and do not affect interpretation.
Words such as “including” mean “including without limitation”.
A reference to a law includes amendments and replacement legislation where appropriate.
A reference to writing may include electronic communication where legally permitted.
85. Language
These Terms are drafted in English.
Translations may be provided for convenience or to satisfy local legal requirements.
Where legally permitted, the English version will prevail in the event of an inconsistency.

requirement will be respected.
